End User License Agreement — Palette Recolor

This agreement is between you and Shohei Yamaguchi, an individual developer ("the developer"), covering the Illustrator extension panel Palette Recolor ("the software"). By installing or using the software you accept these terms.

1. What you get

On purchase you receive a perpetual, non-exclusive, non-transferable license to use the software. Perpetual means the version you buy keeps working; it does not stop at a renewal date, and there is no subscription.

One license covers one person. That person may install the software on the machines they personally work on, including a desktop and a laptop. It does not cover other people. If several people at an organisation use the software, each of them needs a license.

2. Trial

The software can be used without a license for an initial trial covering the first 30 color replacements. The trial is not time limited and does not expire on a date. Once those replacements are used, listing colors and selecting objects on the canvas continue to work indefinitely at no cost; replacing colors requires a license.

Circumventing the trial limit, for example by altering the stored trial record or modifying the software, is not permitted under this agreement.

3. What you may not do

You may not resell, sublicense, rent, or redistribute the software or your license key. You may not publish your license key or share it with others.

The software is distributed as readable script files, which is inherent to the Adobe CEP extension format. You may inspect them. You may not distribute modified copies, remove or defeat the licensing mechanism, or incorporate the code into another product.

4. Updates

Bug fixes and minor updates to the version you purchased are provided at no additional cost when they are released. The developer does not commit to a release schedule, to supporting future Illustrator versions indefinitely, or to providing major new versions free of charge.

5. Refunds

If the software does not work for you, contact the developer within 30 days of purchase and you will receive a refund. You do not need to justify the request. Refunds are processed through Gumroad, the payment provider.

This is in addition to any statutory rights you have, including the right of withdrawal available to consumers in the EU and UK. Those rights are not affected by this agreement.

6. No warranty

The software is provided as is, without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

The software modifies your artwork. Every change it makes can be undone with Illustrator's own undo, and the software does not save, delete, or overwrite your files. Even so, you are responsible for keeping backups of your work, as you would be with any tool.

The developer does not warrant that the software is free of defects, that it will run on every configuration, or that it will remain compatible with future versions of Illustrator.

7. Limitation of liability

To the maximum extent permitted by applicable law, the developer's total liability arising out of or relating to the software is limited to the amount you paid for it.

The developer is not liable for indirect, incidental, special, or consequential damages, including lost profits, lost work, production costs, or reprinting costs, even if advised of the possibility of such damages.

Nothing in this agreement excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of sections 6 and 7 may not apply to you.

8. Termination

This license ends if you breach these terms, in particular sections 2 and 3. On termination you must stop using the software and remove it from your machines. Ending the license does not entitle you to a refund beyond section 5.

9. Governing law

This agreement is governed by the laws of Japan. If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protection provisions of your country of residence, and this clause does not deprive you of the right to bring proceedings where those provisions allow.
